Please read carefully. These Terms and Conditions (the Terms) form a binding agreement between you and Vakantiewoningen (“we”, “us”, “Vakantiewoningen”). By using our website or booking a property through our platform you agree to these Terms. If you represent an owner, you also accept the Owner Terms referenced below.

Bookings Payments and Cancellations

Booking Confirmation

How to book: Bookings are made through our platform and are confirmed only when you receive a booking confirmation email.

Contract: Each confirmed booking creates a contract between the guest and the property owner; Vakantiewoningen acts as the facilitator.

Payments

Accepted methods: We accept the payment methods displayed at checkout.

Timing: Full payment or the required deposit must be received to confirm a booking.

Service fees: A platform service fee and any applicable taxes are added at checkout.

Owner payouts: Owners receive payouts according to the payout schedule in their Owner Agreement.

Cancellation and Refunds

Cancellation policy: Each listing shows its cancellation policy (e.g., Flexible, Standard, Strict). Guests must review the listing’s policy before booking.

Refunds: Refunds are processed according to the listing’s cancellation policy and any applicable processing times.

Changes: Requests to change bookings are subject to availability and may incur fees.

Guest and Owner Obligations Damage and Security Deposit

Guest obligations

House rules: Guests must follow the property’s house rules, occupancy limits, and local laws.

Conduct: Guests must not engage in illegal activity, cause nuisance, or damage the property.

Owner obligations

Accurate listings: Owners must provide accurate property descriptions, pricing, availability, and required amenities.

Safety and compliance: Owners must ensure properties meet local safety and regulatory requirements.

Damage and security deposit

Deposit: Owners may require a security deposit; the amount and terms are shown on the listing.

Claims: Owners may submit damage claims with supporting evidence. We may withhold or deduct from the deposit to cover verified damages.

Dispute: If a guest disputes a damage claim, we will review evidence and may mediate between parties.

Liability Insurance Indemnity and Limitations

Liability

Limited liability: To the maximum extent permitted by law, Vakantiewoningen’s liability for any claim arising from use of the platform or a booking is limited to the total fees paid by the guest for that booking. We are not liable for indirect, incidental, or consequential losses.

Indemnity

Guest indemnity: Guests indemnify Vakantiewoningen and owners for claims arising from guest negligence, breach of house rules, or illegal acts.

Owner indemnity: Owners indemnify Vakantiewoningen for claims arising from property defects, inaccurate listings, or owner negligence.

Insurance

Recommendation: Guests and owners are encouraged to obtain appropriate travel, liability, and property insurance. Owners may be required to maintain insurance as set out in the Owner Agreement.

Privacy Data Use and Intellectual Property

Privacy and data use

Personal data: We collect and process personal data to provide services, process payments, and comply with legal obligations. Our Privacy Policy explains what we collect, how we use it, and your rights.

Third parties: We may share data with payment processors, service providers, and authorities where required by law.

Intellectual property

Content ownership: All content on the platform, is owned by Vakantiewoningen or used under license. Users may not reproduce or use platform content without permission.

Dispute Resolution Governing Law Amendments and Contact

Dispute resolution

Good faith: Parties should attempt to resolve disputes informally first by contacting our support team.

Formal resolution: If informal resolution fails, disputes will be resolved by mediation or arbitration as set out in the Owner Agreement or booking confirmation.

Amendments

Changes to Terms: We may update these Terms. We will post the revised Terms with a new “Last updated” date. Continued use after changes constitutes acceptance.
